- Warrantech Companies – K / S provided vital analysis and tools to allow Warrantech’s forensic accountants to review data from the company’s outmoded tape-based backup systems. Kiersted / Systems' efforts proved crucial to helping the company’s attorneys defend the company in litigation, as well as determine amounts in dispute.
- Unocal Corp. – Unocal faced a potentially destructive lawsuit and needed to determine what it did and did not have in its archives that would support its case and/or become producible. The corporation needed to undertake a high level review of a huge amount of paper records housed in boxes. Kiersted / Systems built a custom box tracking system to assist with the endeavor and helped Unocal devise an efficient process—saving the company months of attorney fees and giving it superior, rock-solid results.
- Class Action Plaintiffs –– Every class action lawsuit takes a different shape. As a result, an off-the-shelf solution may not allow proper tracking of the actions of the many participants in the database. In this case, Kiersted / Systems custom-developed an Asbestos plaintiff database system for tracking tens of thousands of plaintiffs involved in a toxic tort class action suit. Custom-tailored to the unique needs of the project, the system achieved extraordinary accuracy and efficiency. For example, the tools allowed plaintiff attorneys to find cases where the same plaintiff was being represented more than once in the same action, thereby reducing the client’s exposure.
- Major Oil & Gas Company – A leading oil & gas company lost a large case involving thousands of service station owners. As a result, the company needed to mine through vast amounts of paper records spanning a number of years to determine who was owed what, based on contracts, product deliveries, etc. Ultimately, it was a case in which the information simply did not exist in a discoverable form. Kiersted / Systems constructed a system from the ground up to enable the company to gather and analyze the necessary data. It also accessed electronic data dumps from applications and built systems and processes to allow electronic data to be verified against the data collected from raw paper sources.
